Terms of sale

1. What you buy

A stock house plan as a package of digital files (the Plan), and a licence to build one house from it. The design page lists the files of the release you buy; the licence page carries the licence. Sales are offered only to buyers in the United States, for building projects in the United States. You buy for your own use or your own building project, and you confirm you are at least 18 years old.

2. Price and payment

Prices are shown in US dollars. The amount payable is shown on the payment page, after any accepted promotion code. You pay once, on the payment page of our payment provider; we do not see or keep your card details. A payment is complete when our provider confirms it.

3. Delivery

The files are digital and nothing is shipped. After we receive the payment confirmation, we open your download access and send a confirmation email. Your plans are in My plans on this site: you sign in with the email address on your order through a one-time sign-in link we send to that address, and the browser you paid in is signed in for that order. Nothing is attached to the email. The confirmation email also carries the link to your order page, which opens that order without signing in; keep it.

4. What the plan is

The plan is a stock plan, drawn for one baseline set of design criteria. It was not prepared for your site, and no architect or engineer has reviewed, stamped or sealed it. Before construction you have it checked against the building code in force at your site, the conditions of your site and the engineering your jurisdiction requires, and you obtain all permits. The design page and the handoff guide list the work your local professionals complete. The seller provides no professional services and is not your architect, engineer or contractor.

5. Licence

Your use of the files is governed by the one-build licence, in the version shown when you pay. The licence is part of these terms.

6. Refunds and cancellation

The refunds page states what applies: a refund on request within 14 days of purchase if no file of the package has been downloaded, and no refund after a download. A full refund ends the licence and download access.

7. Warranty and liability

1. The Plan is supplied as it is, with all faults, and without any warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and compliance with any code, law or standard. The Publisher does not warrant that the Plan suits your site, climate, soil, jurisdiction or builder, that a permit will be granted for it, or that a house built from it will be free of defects.
2. The Plan is not a substitute for the services of a licensed architect, engineer, surveyor or contractor. Engaging them is your responsibility and at your cost.
3. To the fullest extent the law allows, the Publisher, its owners, officers, employees and contractors are not liable to you or to anyone else for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for any loss of profit, revenue, savings, data, time or opportunity, or for any cost of construction, rework, delay, permit refusal, inspection, repair or demolition, arising from or connected with the Plan, its use or its unavailability, under any theory of liability, even if told that such loss was possible.
4. The Publisher's total liability for all claims arising from or connected with the Plan or this licence, taken together, is limited to the price you paid for this licence.
5. You will indemnify and hold harmless the Publisher against all claims, losses, costs and expenses, including reasonable legal fees, brought by anyone and arising from the construction or use of a house built from the Plan or a changed version of it, from your breach of this licence, or from your failure to obtain the professional review, permits and approvals your site requires.
6. Where the law of your place of residence does not allow an exclusion or limit in this section, that exclusion or limit applies to the extent the law allows, and any warranty that cannot be excluded is limited to the price you paid.

8. Law and disputes

The laws of the Republic of Singapore govern, and the courts of Singapore have exclusive jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Claims are brought individually, not as a class or representative action, and within one year of the event that gives rise to them. If a court finds a term unenforceable, the rest stands.

9. Changes

We may change these terms for future purchases. The terms version you accepted when you started the payment applies to your purchase, and we record that version with your order.

10. Interruptions

We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of our hosting, payment or mail providers. If we cannot deliver a paid package, the refunds page applies and we refund the payment in full.
